XMAS 2019 –
TERMS AND CONDITIONS OF PARTICIPATION
1. ADVENT CALENDAR
1.1
Esprit Retail. B.V & Co. KG (“ESPRIT”), headquartered in Ratingen, Germany, is responsible for organizing this competition.
1.2
Participation will take place on the internet on the respective country domain (see 2.2) and is free of cost to participants, with the exception of internet connection fees incurred by the participant.
1.3
The Advent Calendar will run from 10:00 am on 12.01.2019 until 11:59 pm on 12.24.2019 central European time, “CP” (“competition period”).
1.4
On the 14 days specified before 12.01.2019 (and not to be changed thereafter), the Advent Calendar door conceals an opportunity to win ("winning days"), which is described in further detail in section 4.
2. PARTICIPATION
2.1
In participating, the participant confirms that they agree to these Terms and Conditions of Participation. In order for participants to be contacted in the event that they win, they are required to register one time by providing an e-mail contact address prior to starting the competition.
2.2
Participation is open to anyone who is at least 18 years of age at the time of participation and who resides in one of the following countries: Germany (participation via www.esprit.de), Belgium (participation via www.esprit.be), France (participation via www.esprit.fr), Austria (participation via www.esprit.at), Switzerland (participation via www.espritshop.ch), the Netherlands (participation via www.esprit.nl), Sweden (participation via www.esprit.se), Finland (participation via www.esprit.fi), Denmark (participation via www.esprit.dk), Poland (participation via www.espritshop.pl), Italy (participation via www.espritshop.it), Spain (participation via www.esprit.es), Great Britain (participation via www.esprit.co.uk), the Czech Republic (participation via www.esprit.cz), and who are newsletter subscribers at the time of participation.
2.3
During the participation period, anyone who “opens” the Advent Calendar door on the website on winning days will be entered into the prize draw.
2.4
Participation is not conditional upon the purchase of a product or use of a service.
3. EXCLUSION FROM THE ADVENT CALENDAR WINNINGS
3.1
Employees of ESPRIT and of companies associated with ESPRIT, as well as their family members, are excluded from participation.
3.2
People who (i) provide false personal information, (ii) enter illegal content, or (iii) manipulate or otherwise misuse the electronic equipment implemented for the competition are excluded from participation.
3.3
Remote participants who do not reside in one of the aforementioned countries listed in section 2.2. are excluded from participation.
4. EXECUTION AND IMPLEMENTATION
4.1
Each participant can only participate once a day on the respective current day. However, it is possible to take part several times during the entire competition period.
4.2
All newsletter subscribers from all countries listed in section 2.2 who open the Advent Calendar door on a winning day will be randomly drawn on the following day for a chance to win the respective daily prizes.
4.3
The following items will be drawn as daily prizes on 14 of the calendar days. A participant, however, can only win one prize on any given winning day:
*A total of 25 Esprit vouchers (on 5 days; 5 items per day) each valued at €200
*A total of 5 cozy Esprit gift sets (blanket, candle, socks), (on 1 day; 5 items per day) each valued at €70
*A total of 5 Esprit women’s cashmere gift sets (cashmere scarf, beanie & gloves), (on 1 day; 5 items per day) each valued at €170
*A total of 5 Esprit men’s cashmere gift sets (scarf & beanie), (on 1 day; 5 items per day) each valued at €130
*A total of 5 Esprit genuine leather gift sets (bag & wallet), (on 1 day; 5 items per day) each valued at €170
*A total of 20 Rituals gift boxes (on 4 days; 5 items per day) each valued at €40
*1 my Boo bicycle (1 day; 1 item) valued at €1,500
4.4
Winners of the daily prizes will be notified by e-mail within 2 business days following the respective winning day and will be asked to provide their full address so that they can receive their winnings. Non-winning participants will not be notified.
4.5
Only the prizes described in further detail in section 4.3 will be awarded. Payment in cash or transference of a prize to a third party, even in part, is not possible.
4.6
Prize claims cannot be transferred.
4.7
The winner is personally responsible for the potential taxation of their winnings.
5. UNTIMELY TERMINATION OF THE ADVENT CALENDAR
5.1
ESPRIT reserves the right to terminate the Advent Calendar at any time during the promotional period without prior notice and without stating reasons. This applies in particular if and insofar as this is necessary for organizational or technical reasons (e.g. viruses in the computer system, manipulation or errors in the hardware and/or software) or for legal reasons in one or more countries.
6. LIABILITY
6.1
Once ESPRIT has delivered a prize or made it available in the agreed manner, all obligations on the part of ESPRIT will have been fulfilled.
6.2
Particularly in connection with Esprit products that are issued as prizes, ESPRIT shall only assume liability for damages caused by ESPRIT or one of its subcontractors, whether caused intentionally, as a result of gross negligence or through the violation of cardinal obligations. This restriction does not apply to damages caused by injury to life, body and/or health or to claims under the Product Liability Act.
6.3
The foregoing limitation of liability shall also apply in particular to damages caused by errors, delays or interruptions in the transmission of data or the like, by malfunctions in the technical equipment or service, incorrect content, loss or deletion of data, viruses or through any other similar means.
6.4
ESPRIT provides no warranty, nor does it assume any liability, for all winnings that are not provided by ESPRIT, but rather by third parties. If such third-party winnings do not function properly, are defective, have other defects or if questions arise concerning the use of said winnings, the winner shall immediately contact the respective manufacturer of those winnings.
7. FINAL PROVISIONS
7.1
Complaints relating to the implementation of the Advent Calendar must be made in writing to ESPRIT within 14 days of the reason becoming known. Complaints communicated by telephone or late complaints will not be processed.
7.2
All legal recourse with regard to the execution of the prize draw and its results is excluded.
7.3
The law of the Federal Republic of Germany is exclusively applicable in this matter, irrespective of the location in which the participant takes part in the competition. This does not apply to mandatory consumer protection law at the participant's place of residence.
7.4
Should individual provisions be or become invalid or unenforceable, this shall not affect the validity of the remaining provisions.
