WELLNESS WEEKEND IN RÜGEN COMPETITION
1. Competition
1.1
Esprit Global Image GmbH, Esprit Allee, D-40882 Ratingen (“ESPRIT”) is carrying out this competition. The competition is not connected with Instagram and is not sponsored, supported or organised by Instagram in any way. All questions, comments and complaints regarding the competition should be addressed directly to ESPRIT and not to Instagram. This also applies to any legal claims which may arise during the competition.
1.2
Participation is exclusively online on our global Instagram channel (https://www.instagram.com/Esprit/) and is free of charge for participants (excepting internet connection charges for the participant). The competition is carried out in Germany at ESPRIT headquarters.
1.3
The competition will run from 20th May 2019, 16:00 to 30th May, 23.59 (“Time period of competition”). Times given are local times in the Federal Republic of Germany (Central European Summer/Winter Time “CET”).
2. Participation
2.1
Through participating, the participant expressly agrees to the following conditions of participation.
2.2
All persons who are at least 18 years of age at the time of the competition and reside in Germany are eligible to participate.
Whoever comments on the competition post on the above-named Instagram account within the participation period of the competition can participate.

- Comment on the below-mentioned Instagram competition post and within the comment tag a second person who both follow the Instagram channel.

Participation is not dependent on the purchase or use of services.
3. Disqualification from competition
3.1
Employees of ESPRIT and ESPRIT related companies and their family members are disqualified from participation.
3.2.
Persons who (i) submit false information as personal data, (ii) post illegal content or (iii) manipulate or misuse electronic equipment procured for the competition are disqualified from participating.
3.3
Furthermore, participants who do not reside in Germany are disqualified.
4. Performance and execution
4.1
Each participant can only participate once during the competition period.
4.2.
At the end of the competition period, one winner will be chosen out per draw of all participants and the following prize will be awarded:

The winning package contains the following products and services:
- The winner will win a wellness weekend from 28.06. - 30.06.2019 for 2 persons at „CERÊS AM MEER“ Hotel in Binz (Rügen). The value of all the wellness weekend may not be more than 1200 Euros.
- Two nights in a stylishly furnished 5-star sea deluxe double room with a fascinating view of the sea, incl. breakfast and access to the thermal baths and the seawater pool of the SENSEO SPA
Arrival and departure by Deutsche Bahn 2nd class are included in the profit.
To take part in the competition, you need to be following the Esprit Instagram channel @esprit during the competition period, like & comment the competition post mentioned above and tag one other person.
The person who will get tagged on the post has to follow the Instagram channel as well.
4.4
The winners will be informed by Instagram via direct message on 31st May 2019 and will be requested by ESPRIT to tell Esprit their full name, postal address and e-mail address. If the winner does not respond within 48 hours, the right to the prize lapses. Participants who have not won will not receive any notification.
4.5
Cash payment of the prize is not possible under any circumstances.
4.6
The claim to the prize cannot be transferred to another person.
4.7
The winner is responsible for any possible taxation on his or her prize.
5. Premature ending of the competition
ESPRIT is entitled to end the competition at any time during the competition period without prior notice or justification. This is particularly the case insofar as the measure is necessary due to organisational or technical grounds (e.g. virus in computer system, hacking or error in the hardware/software) or legal grounds in one or more contracts.
6. Notification of the winner
ESPRIT will inform the winner privately via Instagram direct message. The names of the winners are not made public.
7. Liability
7.1
If ESPRIT has handed out a prize or made it accessible in the promised manner, all obligations have been met by ESPRIT.
7.2
ESPRIT is only liable for damages which have been caused intentionally, through gross negligence or through the violation of cardinal obligations by ESPRIT or its agents. This restriction does not apply to damages which pose a threat to life, limb and/or health.
7.3
Existing liability restrictions apply in particular for damages which are caused by errors, delays or interruption in the transfer of data or similar, in the case of malfunctioning technical systems or services, incorrect content, loss or deletion of data, viruses or similar causes.
8. Final provisions
8.1
Complaints which relate to the execution of the competition must be submitted to ESPRIT within 14 days after discovery of the cause in writing. Complaints transmitted by telephone or delayed complaints will not be processed.
8.2
Legal action related to the execution of the raffle draw and its results is not permitted.
8.3
The law of the Federal Republic of Germany applies exclusively, irrespective of the location from which the participant participates. Obligatory consumer protection law in the place of residence of the participant is excluded from this provision.
8.4
Should certain provisions be or become invalid or non-enforceable, the validity of the remaining provisions shall remain unaffected.
